General Terms and Conditions

Diese AGB gelten für alle Angebote und Verträge der RetinaDesign AG, Basel. Abweichende Bedingungen gelten nur nach schriftlicher Bestätigung.

Vertragssprachen: Deutsch und Englisch (maßgeblich ist die deutsche Fassung).

• These General Terms and Conditions apply to all offers and contracts of RetinaDesign AG, Basel. Deviating terms and conditions are only valid after written confirmation.

  Contract languages: German and English (the German version is authoritative).

Our jewelry pieces are custom-made and unique; exchanges/returns are not possible. Standard material and dimensional tolerances in goldsmithing are considered agreed upon.

Two design adjustments are included in the flat rate of CHF 400 per piece of jewelry. Additional changes will be charged at cost—always with prior notification.

• By consenting to the retina scan and accepting these terms and conditions, you agree to the processing of biometric data for the purpose of jewelry production.
  Standard: Retina data is stored for reorders without the need for a new scan. Deletion at any time upon request.
  Data is only shared with authorized service providers (production/logistics/IT) to the extent necessary for order fulfillment – never for advertising purposes.

Start after written approval of the drafts/visualizations and receipt of the down payment. Changes after the start may incur additional costs or be technically impossible.

• Approximate timeframe: approx. 2 months (non-binding).
  Express service available depending on capacity and at an additional cost; delivery date will be confirmed individually.
  Delays (suppliers, gemstone availability, force majeure) do not entitle the customer to withdraw from the contract.

Until full payment has been made, the jewelry remains the property of RetinaDesign AG.

• 50% deposit upon order (non-refundable).
  Remaining payment before handover/shipping; for shipping, 100% in advance.
  Cancellation after production has begun: costs already incurred will be charged.

Shipping is insured. Upon transfer to the transport service provider, the transport risk is transferred to the customer.
Explanation: Transport insurance replaces the value (after inspection) in the event of damage, but does not change who bears the risk. We provide support in the settlement of claims.
International shipping: Customs-related information (phone number, email address, tax ID if applicable) may be required. If mandatory information is missing, you must take out your own transport insurance; we are not liable. Customs duties, taxes, and fees in the recipient country are borne by the customer.

Erklärung: Die Transportversicherung ersetzt im Schadenfall den Wert (nach Prüfung), ändert aber nicht, wer das Risiko trägt. Wir unterstützen bei der Schadenabwicklung.

Auslandsversand: Zollrelevante Angaben (Telefon, E‑Mail, ggf. steuerliche ID) können nötig sein. Fehlen Pflichtangaben, ist eine eigene Transportversicherung abzuschließen; unsere Haftung entfällt. Zoll/Steuern/Gebühren im Empfängerland trägt die Kundschaft.

Es gelten die gesetzlichen Mängelrechte nach OR. Zusätzlich: 24 Mona

The statutory warranty rights under the Swiss Code of Obligations apply. In addition: 24-month voluntary processing warranty from acceptance/delivery for manufacturing defects (e.g., solder joints, casting defects, barrel finishing).

12-month setting guarantee: If a stone becomes loose or falls out without external influence, we will repair it free of charge. Excluded: Impact, bending, falling, and similar mechanical damage (individual cases will be assessed).

• Normal wear and tear (micro-scratches, loss of polish/matt finish), coatings (e.g., rhodium plating), chemical influences (e.g., chlorine), heat/cold shocks, improper handling by third parties.
  Alloys below 18 karat: natural color changes possible.
  Red gold: due to a higher copper content, color nuances may occur in individual cases, even with 18 karat – not covered by warranty.
  Tantalum: size changes technically impossible or only possible to a limited extent.

• Repolishing/re-matting for Retina jewelry: free of charge.
  Size adjustments for rings without gemstone settings: free of charge (if technically possible).
  For gemstone settings, we only charge for the additional work involved.

Report obvious defects immediately and hidden defects as soon as they are discovered. Send photos/videos and bring the item in for inspection or send it by insured mail. We will primarily provide repairs; otherwise, we will replace equivalent parts or offer an appropriate reduction in price.

• 14-day cancellation only applies to non-customized items.
  Custom-made items (Retina jewelry) are excluded from cancellation.
  Details on deadlines/refunds/returns: Cancellation policy (order confirmation/website).

Rechnungen werden per E‑Mail übermittelt. Rechtserhebliche Erklärungen können elektronisch erfolgen.

Invoices are sent by email. Legally binding declarations can be made electronically.

• Designs, CAD/3D data, photos, and texts remain the intellectual property of RetinaDesign AG.
  With your purchase, you acquire the unrestricted right to wear and privately use the physical piece of jewelry. Not included: reproduction/commercial replication (e.g., replication by third parties, use of our design data).
  Unless expressly objected to at the latest upon acceptance, we may use photos of the jewelry as a reference (website, social media, print).

Swiss law applies. The place of jurisdiction is Basel.

• Force majeure: Events beyond our control shall suspend our obligation to perform.
  Severability: The invalidity of individual provisions shall not affect the validity of the remaining provisions.
  Amendments: The version of the General Terms and Conditions valid at the time of the order shall apply.
